General Terms and Conditions

1. Scope, Applicable Law, Jurisdiction

1.1 For all deliveries from cat-on (hereinafter referred to as "cat-on") to consumers on this website, these General Terms and Conditions shall apply exclusively in the version valid at the time of the order. A consumer is defined as any person as per § 13 BGB (German Civil Code), i.e., natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. In other cases, customers are considered entrepreneurs as per § 14 BGB. 1.2 Guarantees, assurances, side agreements, and amendments to the contract must be made in writing to be effective. This applies in particular to the amendment of the written form requirement itself. An oral modification of the written form requirement is invalid. 1.3 German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

2. Offer and Conclusion of Contract

2.1 Your order and its transmission constitute an offer to cat-on to conclude a purchase contract. 2.2 Upon receipt of the order, cat-on will confirm the receipt of the order via email. This order confirmation does not constitute an acceptance of the offer to conclude a purchase contract but exclusively confirms the receipt of the order. 2.3 The purchase contract between you and cat-on is only concluded upon the provision of the ordered goods for dispatch by cat-on and the sending of a second notification to you via email (Shipping Confirmation). 2.4 Product images on the website are partially exemplary and may differ from the ordered or delivered products. 2.5 All products are sold only in quantities customary for households.

3. Delivery

3.1 Unless otherwise agreed, delivery shall be made to the delivery address specified by you. 3.2 In the event of non-availability, cat-on is entitled to execute the order at a later date within a reasonable period. In this case, you will receive an immediate written notice informing you of a later delivery date. 3.3 If the delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. 3.4 The primary shipping is handled by the parcel service of your choice. For large shipping volumes with multiple shipments, we reserve the right, for reasons of sustainability and efficiency, to distribute additional partial shipments to other parcel services if necessary.

4. Cancellation Policy (Right of Withdrawal)

Right of Withdrawal You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Note on the Right of Withdrawal

Not part of the formal Cancellation Policy. The right of withdrawal does not apply to distance contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

6. Complaints

We seek customer-oriented solutions even in legal matters. Your rights remain fully intact even without a phone call. 7. Shipping Costs

7.1 Shipping costs depend on the quantity of ordered goods and the shipping method and will be clearly communicated to you before you submit your binding order. 7.2 Shipping flat rate Germany: Within Germany, we charge a flat rate of 6.90 EUR with DPD and, following a price increase by DHL, 7.90 EUR. 7.3 Shipping flat rate EU: 12.90 to 60.00 EUR. (Belgium, Denmark, Finland, France [excl. Corsica], Greece, Great Britain, Ireland, Italy, Croatia, Luxembourg, Netherlands, Norway, Austria, Czech Republic, Poland, Portugal, Spain [excl. Balearic Islands], Slovakia, Sweden, Hungary). Attention: For international shipping, subsequent address corrections result in processing fees of 15.00 EUR from the shipping companies, which we must pass on to you. 7.4 Shipping flat rate Switzerland: 22.50 EUR. Norway: 29.50 EUR. Sales are net, excluding VAT. 7.5 Shipping costs for non-EU countries are calculated individually. 7.6 For island destinations such as Corsica or the Balearic Islands, we reserve the right to recalculate shipping costs individually.

8. Payment and Shipping

8.1 cat-on delivers against advance payment (2% discount), Sofortüberweisung, Giropay, PayPal, Visa, Mastercard, American Express, iDeal, Bancontact, Postepay, Maestro, Google Pay, and Apple Pay. Our PayPal address is: paypal@cat-on.com 8.2 For advance payment: Recipient: -> THIS AREA IS CURRENTLY UNDER REVISION <- Upon provision of the goods for dispatch, you will receive an invoice together with the shipping confirmation. 8.3 Delivery time is 7 to 12 business days within Germany. 8.4 If payment is not received within 14 days after sending the invoice, cat-on is entitled to withdraw from the contract. Further legal claims remain unaffected. 8.5 International payments can be processed more cost-effectively if the IBAN and SWIFT codes are provided.

9. Retention of Title

The delivered goods remain the property of cat-on until full payment has been received.

10. Warranty and Liability

10.1 Any description of our products is a pure service description and does not constitute a guarantee for the quality, suitability for a specific purpose, or durability. Guarantees require a separate written agreement. 10.2 In the event of a defect, you may request supplementary performance (rectification or replacement). If supplementary performance fails, you may withdraw from the contract or reduce the purchase price in the case of a significant defect. Claims for damages are subject to sections 10.3 to 10.6. 10.3 In cases of intent, claims under the Product Liability Act, and injury to life, body, or health, cat-on is liable according to statutory regulations. 10.4 In the event of the death or injury of an animal, cat-on is liable exclusively in cases of intent or gross negligence and according to the Product Liability Act. 10.5 In the case of gross negligence, liability is limited to typically foreseeable damages; this does not apply if caused by executive employees. 10.6 cat-on is not liable for damages caused by simple negligence. 10.7 In the case of a replacement delivery, cat-on may make the delivery dependent on the return of the defective item. 10.8 If the delivery shows obvious external damage (e.g., torn box) upon handover, please open it in the presence of the carrier if possible and compare the content with the invoice. Obtain written confirmation of damage or missing items from the carrier if possible. Please report transport damage and incomplete deliveries immediately, preferably in writing. We must report transport damage to our insurer within 48 hours, otherwise our claim expires.

11. Data Protection

Disclosure to third parties: cat-on uses your personal information only within the online shop to process orders. We do not pass data to third parties without express consent, except for service providers (DHL, GLS, DPD, Spedition, Payment providers) necessary for contract fulfillment. Google Analytics: This website uses Google Analytics. Information generated by the cookie (including IP address) is transmitted to Google in the USA. You can prevent cookie installation via browser settings. Facebook Social Plugins: Our site uses Facebook Social Plugins (Facebook Inc., USA). When visiting a page with a plugin, a connection to Facebook servers is established. Log out of Facebook before visiting our site to prevent data association.

12. Packaging Ordinance

In accordance with legal requirements, we have concluded an entry contract with "Der Grüne Punkt – Duales System Deutschland GmbH." Please dispose of packaging via your local recycling system.

13. Miscellaneous

13.1 The contract language is German. 13.2 Contracts are subject to German law, excluding the CISG, even for international orders. For returns from abroad, the customer bears the return postage. 13.3 Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected. 13.4 In cases of force majeure (war, natural disasters), cat-on is exempt from performance for the duration of the hindrance. Invalid provisions shall be replaced by legally permissible regulations that come closest to the original intent.
